The EU AI Act (Regulation 2024/1689) enters its most consequential phase on 2026-08-02. On that date, the high-risk AI system obligations under Chapter III become enforceable — including Article 9 (risk-management systems), Article 10 (data governance), Article 12 (record-keeping), and Article 14 (human oversight). The penalty for non-compliance: €35M or 7% of global annual turnover, whichever is higher.
Web3 builders have largely ignored this deadline. That's a mistake. Annex III §5 of the AI Act classifies AI systems used in financial services — including credit scoring, insurance risk assessment, and autonomous trading — as high-risk by default. Autonomous DeFi agents, AI-driven governance proposal systems, and LLM-based portfolio managers fall directly in scope.
Who Is Actually in Scope?
The EU AI Act applies to any provider or deployer whose AI system is placed on the EU market or whose output affects EU persons — regardless of where the provider is incorporated. A DeFi protocol governed by a Wyoming LLC whose governance bot sends proposals affecting EU token holders is in scope.
- Autonomous DeFi trading agents executing on-chain transactions based on LLM outputs
- AI-driven governance proposal systems (e.g., agents that draft and submit on-chain governance votes)
- LLM-based risk assessment tools used in lending protocol underwriting
- AI agents managing treasury positions on behalf of DAOs with EU token holders
- Prediction market resolution agents that use AI to determine event outcomes
Article 9: The Risk-Management System Requirement
Article 9 requires providers of high-risk AI systems to establish, implement, document, and maintain a risk-management system throughout the AI system's lifecycle. This is not a one-time audit — it's an ongoing operational obligation. The risk-management system must:
- Identify and analyze known and reasonably foreseeable risks
- Estimate and evaluate risks that may emerge when the system is used as intended
- Evaluate risks based on data from post-market monitoring
- Adopt appropriate risk-management measures (including testing before deployment)
- Be documented — regulators can demand the documentation at any time
Key distinction: Article 9 requires documented risk management, not just technical safeguards. A system that blocks dangerous outputs but produces no audit artifacts fails the Article 9 documentation requirement. SL-2 produces Article 9-compliant audit artifacts automatically on every guardrail check.
Article 14: Human Oversight
Article 14 requires that high-risk AI systems be designed and developed to allow effective oversight by natural persons during the period of use. For autonomous DeFi agents, this creates a design constraint: the system must have a mechanism for a human to intervene, override, or halt the system.
This does not mean every action requires human approval — it means the system must be designed so that human intervention is possible. A pause function, an emergency multisig, or a human-review queue for borderline decisions all satisfy Article 14.
The Practical Compliance Checklist
- [ ] Map every AI component that affects EU persons — including third-party LLM APIs used in decision pipelines
- [ ] Classify each component against Annex III — financial services classification applies broadly
- [ ] Implement Article 9 risk documentation: written risk register, test results, ongoing monitoring process
- [ ] Deploy pre-action guardrails that produce Article 9 audit artifacts on every decision
- [ ] Implement Article 14 human oversight mechanism (pause function, multisig override, review queue)
- [ ] Establish Article 12 record-keeping: logs must be kept for at least 6 months after the system is decommissioned
- [ ] Register in the EU AI database if required (Article 49 — mandatory for high-risk systems)
- [ ] Appoint an EU representative if incorporated outside the EU (Article 25)
